Terms & Conditions

These terms and conditions are effective as of December 11, 2020.  

By downloading or using SoundingBoard (App), these terms will automatically apply to you – you should make sure therefore that you read them carefully before using the App.

  • You are not allowed to copy, or modify the App, any part of the App, or our trademarks in any way.
  • You are not allowed to attempt to extract the source code of the App, and you also should not try to translate the App into other languages or make derivative versions.
  • The App itself, and all the trademarks, copyright, database rights and other intellectual property rights related to it, still belong to AbleNet, Inc.

AbleNet, Inc. is committed to ensuring that the App is as useful and efficient as possible. For that reason, we reserve the right to make changes to the App or to charge for its services, at any time and for any reason. We will never charge you for the App or its services without making it very clear to you exactly what you are paying for.

AbleNet, Inc. does not receive any personal data. The App stores all your data locally on the device you use. If Sync is enabled, the App stores a copy of your local data in your iCloud Drive. It is your responsibility to keep your phone and access to the App secure. We therefore recommend that you do not jailbreak or root your phone, which is the process of removing software restrictions and limitations imposed by the official operating system of your device. It could make your phone vulnerable to malware/viruses/malicious programs, compromise your phone’s security features and it could mean that the App won’t work properly or at all.

 

You should be aware that there are certain things that AbleNet, Inc. will not take responsibility for. Certain functions of the App will require the App to have an active internet connection. AbleNet, Inc. cannot take responsibility for the App not working at full functionality if you don’t have access to an internet connection.

If you are using the App on a mobile data plan or paid internet plan, you should remember that your terms of the agreement with your data provider will still apply. As a result, you may be charged by your data provider for the cost of data for the duration of the connection while accessing the App, or other third-party charges. In using the App, you are accepting responsibility for any such charges, including roaming data charges if you use the App outside of your home territory (i.e. region or country) without turning off data roaming. If you are not the bill payer for the device on which you are using the App, please be aware that we assume that you have received permission from the bill payer for using the App.

AbleNet, Inc. cannot always take responsibility for the way you use the App i.e. You need to make sure that your device stays charged – if it runs out of battery and you cannot turn it on to avail the Service, AbleNet, Inc. cannot accept responsibility.

With respect to AbleNet, Inc.’s responsibility for your use of the App, when you are using the App, it is important to bear in mind that although we endeavor to ensure that it is updated and correct at all times. AbleNet, Inc. accepts no liability for any loss, direct or indirect, you experience as a result of relying wholly on this functionality of the App.

At some point, we may wish to update the App. The App is currently available on iPadOS – the requirements (and for any additional systems we decide to extend the availability of the App to) may change, and you’ll need to download the updates if you want to keep using the App. AbleNet, Inc. does not promise that it will always update the App so that it is relevant to you and/or works with the iPadOS version that you have installed on your device. However, you promise to always accept updates to the application when offered to you. We may also wish to stop providing the App and may terminate use of it at any time without giving notice of termination to you. Unless we tell you otherwise, upon any termination, (a) the rights and licenses granted to you in these terms will end; (b) you must stop using the App, and (if needed) delete it from your device.


Changes to This Terms and Conditions

We may update our Terms and Conditions from time to time. You are advised to review this page periodically for any changes.

Privacy Policy

Article 1 – Definitions 

  1. APPLICABLE APPLICATION: This Privacy Policy will refer to and be applicable to the SoundingBoard app, which shall hereinafter be referred to as "App."
  2. EFFECTIVE DATE: "Effective Date" means the date this Privacy Policy comes into force and effect.
  3. PARTIES: The parties to this privacy policy are the following data controller: AbleNet, Inc. ("Data Controller") and you, as the user of this App. Hereinafter, the parties will individually be referred to as "Party" and collectively as "Parties."
  4. DATA CONTROLLER: Data Controller is the publisher, owner, and operator of the App and is the Party responsible for the collection of information described herein. Data Controller shall be referred to either by Data Controller's name or "Data Controller," as listed above. If Data Controller or Data Controller's property shall be referred to through first-person pronouns, it shall be through the use of the following: us, we, our, ours, etc.
  5. YOU: Should you agree to this Privacy Policy and continue your use of the App, you will be referred to herein as either you, the user, or if any second-person pronouns are required and applicable, such pronouns as 'your", "yours", etc.
  6. PERSONAL DATA: "Personal DATA" means personal data and information that we obtain from you in connection with your use of the App that is capable of identifying you in any manner.

Article 2 – General Information 
This privacy policy (hereinafter "Privacy Policy") describes how we collect and use the Personal Data that we receive about you, as well as your rights in relation to that Personal Data, when you visit our App and interact with it in any way, including passively.

We are committed to the protection of your privacy while you use our App.

By continuing to use our App, you acknowledge that you have had the chance to review and consider this Privacy Policy, and you acknowledge that you agree to it. This means that you also consent to the use of your information and the method of disclosure as described in this Privacy Policy. If you do not understand the Privacy Policy or do not agree to it, then you agree to immediately cease your use of our App.

Article 4 – Location 
Please be advised the data processing activities take place in the United States, outside the European Economic Area. Article 5 – Modifications and Revisions
We reserve the right to modify, revise, or otherwise amend this Privacy Policy at any time and in any manner. It is also your responsibility to periodically check this page for any such modification, revision or amendment.


Article 6 – The Personal Date We Receive From You
AbleNet, Inc. does not receive any personal data. The App stores all your data locally on the device you use. If Sync is enabled, the App stores a copy of your local data in your iCloud Drive.


Article 7 – Modifying, Deleting, and Accessing Your Information

Article 8 – Acceptance of Risk
By continuing to our App in any manner, use the Product, you manifest your continuing asset to this Privacy Policy. You further acknowledge, agree and accept that no transmission of information or data via the internet is not always completely secure, no matter what steps are taken. You acknowledge, agree and accept that we do not guarantee or warrant the security of any information that you provide to us, and that you transmit such information at your own risk.


Article 9 – Your Rights
You have many rights in relation to your Personal Data. Specifically, your rights are as follows:

  • the right to be informed about the processing of your Personal Data
  • the right to have access to your Personal Data
  • the right to oppose or limit the processing of your Personal Data
  • the right to request that we stop processing and delete your Personal Data
  • the right to block any Personal Data processing in violation of any applicable law
  • the right to launch a complaint with the Federal Trade Commission (FTC) in the United States of America or applicable data protection authority in another jurisdiction
